Terms of Service

These are starter terms of service drafted by Nestfinder engineering. They have not yet been reviewed by an Australian solicitor. Final wording will be revised before any paid launch.

1. Acceptance

By creating an account or using Nestfinder, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the service.

2. Account terms

• You must be 18 years of age or older to create an account.
• One account per person. Accounts are not transferable.
• You are responsible for keeping your password secure. Tell us at support@nestfinder.au if you suspect your account has been accessed without authorisation.
• We may suspend or terminate accounts that violate these Terms.

3. Acceptable use

You agree that you will not:

• Scrape the Nestfinder application or its API at a rate that meaningfully exceeds normal interactive use.
• Reverse-engineer, decompile, or otherwise attempt to derive source code from the application beyond what is permitted by law.
• Abuse the rate limit or attempt to circumvent it.
• Use Nestfinder to harass, defame, or otherwise harm any person.
• Attempt to gain unauthorised access to the service, related systems, or another user's account.
• Use Nestfinder to make automated decisions about people in a way that would be unlawful under the Privacy Act, anti-discrimination law, or the Australian Human Rights Commission Act.

4. Data licensing and attribution

Nestfinder displays aggregate statistics derived from public sources including the Australian Bureau of Statistics (ABS), MySchool, aggregated real-estate listings data, and other providers. The datasets behind these statistics are named on the Methodology page.

You acknowledge that:

• We do not warrant the accuracy, completeness, or currency of any third-party data displayed in Nestfinder.
• Where third-party data is licensed under specific terms (e.g. ABS data under Creative Commons Attribution 4.0), those terms continue to apply. You must observe them if you redistribute output that incorporates the data.
• We display aggregate statistics, not raw upstream rows. We always link back to the upstream source where one exists.

5. No warranty

Nestfinder is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by Australian law, our total liability to you in connection with the service is limited to the greater of (a) any fees you have paid us in the prior 12 months, or (b) AUD $100. This limitation does not exclude liability that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).

6. Property decisions are yours

Nestfinder is a research tool. It does not provide financial, legal, or real-estate advice. Any decision to buy, rent, or invest in property is solely your own. We strongly recommend consulting an appropriately licensed adviser before making any property decision.

7. Changes to the service

We may change, suspend, or discontinue features at any time. We will endeavour to give reasonable notice of material changes.

8. Changes to these Terms

We will update this page when these Terms change and bump the "Last updated" date at the top. Material changes will be announced in-app.

9. Governing law and jurisdiction

These Terms are governed by the laws of Victoria, Australia. You and we submit to the exclusive jurisdiction of the courts of Victoria.
